DUI Penalties in New Jersey

The consequences of a DUI are far-reaching and can easily be one of the most stressful moments of your life.

First Offense:

  • Up to 30 days in jail
  • Fines between $250 - $400
  • Between 12 and 48 hours in an Intoxicated Driver Resource Center (IDRC)
  • License suspension up to three months
  • Possible installation of an ignition interlock device

For those with a BAC higher than 0.10%, the penalties increase, including higher fines and license revocation for up to one year.

Second Offense:

  • Up to 90 days in jail, with a minimum of 48 hours served
  • Fines between $500 - $1,000
  • 30 days of community service
  • License suspension for 2 years
  • Mandatory participation in the IDRC
  • Installation of an ignition interlock device for up to three years following license restoration

Third Offense:

  • Up to 180 days in jail
  • $1,000 fine
  • License suspension for 10 years
  • Mandatory participation in the IDRC
  • Installation of an ignition interlock device for up to three years following license restoration

These penalties for a third offense apply to subsequent offenses, as well.

Beyond these penalties is also the strain a DUI will put on your reputation and employment prospects. Simply put: you have too much at stake to risk a DUI over the 4th of July weekend.
